Abstract
This paper takes part in the research project belonging to the National University of Comahue, Atlantic Zone Regional University Center, entitled: "Destinations of de(s)ubjectivation in childhood/s and adolescence/s, intersections and community" (PI V112) directed by Dr. Patricia Weigandt and co directed by B.C. and Prof. Marina La Vecchia. Its objective is, on the one hand, to present a complex adoption case that has gone through the recursive instances of the Judicial Power of the province of Río Negro, to analyze the sentences involved, the Higher Interest of the Child, the right to be heard, the process of jurisdictional dispute between her biological mother and her parents and, on the other hand, regarding our investigation, how the process of de(s)subjectivation produced by the sentence, operate on the subjetctivation of a 9-year-old girl, to whom we will call Lucia. The data and access to the story of the girl were possible through the interview that I was able to give to Lucia, her mother and the lawyers working on the case from the request of one of the lawyers to whom I subscribe, in the framework of a private consultation to have an interdisciplinary reading.
Resumen
El presente escrito se enmarca en el Proyecto de investigación perteneciente a la Universidad Nacional del Comahue, Centro Universitario Regional Zona Atlántica, titulado: “Destinos de(s)ubjetivación en infancia/s y adolescencia/s, intersecciones y comunidad” (PI V112) dirigido por la Dra. Patricia Weigandt y co dirigido por la Lic. y Prof. Marina La Vecchia. Tiene por objetivo, por un lado, presentar un caso complejo de adopción que ha atravesado las instancias recursivas del Poder Judicial de la provincia de Río Negro, analizar las sentencias involucradas, el Interés Superior del Niño, el derecho a ser oído, como se juega el devenir de la disputa jurisdiccional entre su madre biológica y sus padres, y por otro, en lo concerniente a nuestra investigación, cómo operan en el proceso de subjetivación de una niña de 9 años, a quien llamaremos Lucía, y los efectos de(s)ubjetivantes a partir de las sentencias. Los datos y el acceso a la historia de la niña fueron posibles a través de la entrevista que pude realizarle a Lucía, a su mamá y a los abogados que trabajan en el caso a partir de la demanda de uno de los abogados a quien suscribe, en el marco de una consulta privada para disponer de una lectura interdisciplinaria.
