Abstract
The present work is part of the Research Project V094 "Present sufferings in infancies and adolescences. The Place for Institutional Approaches: Community Work before what resists ", directed by Dr. Patricia Weigandt and co-directed by B.A. and Prof. Marina La Vecchia, from the National University of Comahue (U.N.Co.), Atlantic Zone Regional Universitary Center (CURZA). This current work has a double purpose. On one hand, it tries to make visible a right which is unseen by the law: the right to legally interrupt pregnancy, or non-punishable abortion. On the other hand, to question the subjective building process which allows the subject’s advent. The set of national and international rules will be the co-ordinates which will lead us along this path to warn about illegal regulations on the institutional practices of non-punishable abortion. Likewise, psychoanalytical theoretical frame´s contributions will be taken into account in order to question the mother-child function status and to tell the differences with the institutional discourse of law, health and media which violate Human Rights as they force, judge and criminalize women in an abortive situation.
Resumen
El presente trabajo se enmarca en el Proyecto de Investigación V094 “Los padecimientos actuales en las infancia/s y adolescencia/s. El lugar de los abordajes institucionales: el trabajo comunitario ante lo que resiste”, dirigido por la Dra. Patricia Weigandt y codirigido por la Prof. y Lic. Marina La Vecchia, del Centro Universitario Regional Zona Atlántica (CURZA). Nuestro trabajo tiene un doble propósito. Intenta, por un lado, visibilizar un derecho oculto en la ley: el derecho a la interrupción legal del embarazo o aborto no punible. Y por otro, interpelar sobre el proceso de constitución subjetiva que posibilita el advenimiento en sujeto. El conjunto de normas nacionales e internacionales serán las coordenadas que nos guiarán a lo largo de este recorrido para advertir sobre la legalización de lo ilegal en las prácticas institucionales sobre el aborto no punible. Asimismo, tomaremos los aportes del marco teórico psicoanalítico a fin de poner en cuestión el estatuto de las funciones de hijo/a y de madre y diferenciarlas con la letra del discurso de instituciones judiciales, de salud y mediáticas que vulneran los Derechos Humanos al violentar, judicializar y criminalizar a la mujer en situación de aborto.
